L’utilizzo dell’investigatore privato nella revisione dell’assegno di mantenimento

L’assegno di mantenimento ha le sue fondamenta radicate nell’art 143 c.c., il quale afferma che ogni coniuge ha il dovere di assistenza morale e materiale all’interno della coppia “Entrambi i coniugi sono tenuti, ciascuno in relazione alle proprie sostanze e alla propria capacità di lavoro professionale o casalingo, a contribuire ai bisogni della famiglia.”

L’onere del pagamento viene assegnato, di solito, al coniuge “reo” di aver ammesso in crisi il sodalizio matrimoniale. In base alle varie situazioni di coppia e all’addebito viene stabilita una cifra da corrispondere mensilmente. Il mancato pagamento è punibile secondo l’art 570 c.p.

Esistono però delle situazioni che permettono di richiedere la revisione di tale assegno.

E’ in questi spazi di manovra, che, l’operato dell’investigatore privato diventa fondamentale per richiedere, e ottenere, la revisione dell’assegno di mantenimento. Infatti nei casi in cui il coniuge creditore inizi una nuova convivenza more uxorio, è possibile per il coniuge debitore, attraverso l’operato di un investigatore privato, dimostrare tale convivenza stabile e duratura ( foto e video del coniuge creditore, che vive insieme al nuovo partner, o che fanno la spesa o utilizzano le rispettive auto o comunque tutte le situazioni atte a dimostrare la convivenza).

Altra situazione potrebbe essere l’inizio di un’esperienza lavorativa (anche pregressa), anche in nero, del coniuge creditore, sempre attraverso l’utilizzo di un investigatore privato, il quale certificherebbe l’attività lavorativa del coniuge. La dimostrazione di tale attività lavorativa permetterà la richiesta di riduzione dell’assegno di mantenimento.
